Terms of the Agreement
1.1 These terms apply when the owner of a property (the “owner”), or the owner’s authorised manager or agent, offers to rent the property (“the Holiday House”) to a guest (the “guest”). Under this Agreement, the guest agrees to rent the Holiday House from the owner and the owner agrees to rent the Holiday House to the guest on the terms of this agreement (the “Agreement”).
2.1 A booking is made when a guest contacts the owner of the Holiday House, the owner and guest agree to rent the Holiday House for the term for a price (the “rental”), and the guest pays a deposit. Confirmation of a booking will be provided to the guest once the deposit has been received by the owner.
2.2 The owner has set out terms and conditions which apply to the booking within this rental agreement. The guest agrees to comply with these terms once the deposit has been received by the owner.
2.3 Subject to the cancellation provisions of this Agreement, once a booking is confirmed in writing by the owner the guest is liable for the balance of the rental.
3. Security & Reservation Deposits
3.1 The guest must, to confirm a booking, pay a reservation deposit of £99* of the total balance of the holiday. This must be received within 5 working days of booking the Holiday House.
3.2 The guest will also be required to pay a refundable security deposit of £250. The deposit is fully refundable at the time of checkout dependant on the property being in good order and provided the following provisions are met:
- No damage is done to the property or its contents, beyond normal wear and tear.
- All keys are returned
- All rubbish is placed in the rubbish bin, and soiled dishes are placed in the dishwasher and cleaned.
- All charges accrued during the stay are paid prior to departure.
- No linens are lost or damaged
- The BBQ is left clean
- The guest has not been found to have been smoking in the property
- The guest has not been found to have blocked the septic tank by flushing anything other than toilet paper down the toilets
- The guest is not evicted by the owner
- All air conditioning controls and left in the house
3.3 Where loss or damage to the Holiday House or its contents exceeds the amount of the security deposit, the owner will bill the guest for the shortfall and the guest agrees to pay. In the event that the guest fails to pay any shortfall, the owner reserves the right to exercise any legal remedies to pursue the amount owed from the guest.
4.1 Balance is required in full 6 weeks prior to arrival via bank transfer, Paypal or credit card.
4.2 In the event that the booking is made within 6weeks of arrival, then both the security/reservation deposit and the rent is payable in full immediately.
5. Amendments and Cancellations
5.1 Any cancellation or amendment must be in writing.
5.2 The owner may refuse to amend a booking once it has been confirmed in writing and any amendment or transfer of deposit to another booking will be at the sole discretion of the owner.
5.3 The owner may cancel a booking by notice in writing if the guest fails to make any payment due under this Agreement when that payment is due.
5.4 If a guest cancels this Agreement more than 6 weeks prior to the commencement of the term the deposit shall be forfeited by the guest. The balance of the rental will not be payable.
5.5 If the guest cancels this Agreement fewer than 6 weeks prior to the commencement of the term the rental will remain payable by the guest.
5.6 If the owner cancels this Agreement at any time prior to the commencement of the term the owner will refund the guest any money paid prior to cancellation.
5.7 In the event of the guest cancelling the rental, the owner will try and secure a new booking with an alternative guest. If the owner is successful in securing an alternative booking then any rental paid will be refunded in full, minus a small admin fee (£25).
5.8 If a guest cancels a booking and is entitled to a refund then the refund will be made within 14 days.
5.9 In the event of early checkout, the guest is responsible for the entire reservation and will be charged as such if the remainder of the reservation cannot be rebooked.
6. Occupation of the Holiday House
6.1 The guest must not permit more people to occupy the Holiday House than the number stipulated by the owner below:-
Casa Uva (House 1) 3 bedrooms 6 guests
Casa Oliva (House 2) 3 bedrooms 6 guests
Casa Almendra (House 3) 2 bedrooms 4 guests
Plus infants in cot/travel cot up to a maximum of one per bedroom.
6.2 All guests must not smoke in the Holiday House. Smoking is permitted outside of the Holiday House provided all guests ensure that all associated rubbish is removed at the end of the term. Guests found to be smoking inside the property will automatically forfeit their security deposit.
6.3 The owner may enter the Holiday House at any time to inspect the Holiday House, provided the owner gives the guest not less than 2 hours’ notice. Such notice shall be provided in person.
6.4 The Holiday House will be available for occupation from 4.00 p.m. on the day of arrival and must be vacated by 10.00 a.m. on the day of departure. The arrival and departure times may be varied by agreement between the owner and the guest in writing.
6.5 Pets are not permitted at the Holiday House.
6.6 The owner accepts no responsibility for any loss, or damage, to any of the guest’s personal belongings at the Holiday House.
6.7 The Holiday House runs on wells and a septic system. The owners ask that guests use water sensibly during their stay and avoid unnecessary wastage. The septic system is very effective, however, it will clog up if improper material is flushed. DO NOT FLUSH ANYTHING OTHER THAN TOILET PAPER. No feminine products, wipes, nappies, kitchen roll etc should be flushed at any time. If it is found that anything other than toilet paper has been flushed and clogs the septic system, the guest will forfeit the return of the security deposit.
7. Housekeeping Service
7.1 Other than the usual cleaning services pre / post check in / out, cleaning services are not included in the rental rate.
7.2 Linens, bath and beach towels are included in the rental rate.
7.3 For stays of 14 nights or more a mid-stay clean is included free of charge. This will include a change of bed linen and towels, cleaning of bathrooms and all floors.
7.4 The owners do not permit bath towels or linens to be taken from the Holiday House.
7.5 Extra beach towels can be provided free of charge.
7.6 Extra cleaning services are available at an additional cost.
8. Insurance & Health
8.1 The guest undertakes that it will not do, permit to be done, or omit to do, any action that does or may invalidate or adversely affect any insurance policy held by the owner in respect of the Holiday House and/or its contents.
8.2 The guest agrees to indemnify the owner against any losses or damages suffered by the owner as a consequence of the guest’s breach of its obligations under clause 8.1.
8.3 It is the responsibility of the guest to take out adequate travel insurance cover for the duration of their trip, for the whole group and to include cover for unplanned cancellation.
8.4 The owner advises the guest to apply for a European Health Insurance Card (EHIC) before travel. A valid European Health Insurance Card gives guests the right to access state-provided healthcare during a temporary stay in another European Economic Area (EEA) country or Switzerland. The EHIC covers treatment that is medically necessary until the planned return home of the guest. One card will be needed for every person in the travelling group. 9. Falsified Bookings
Any booking obtained under false pretence will be subject to forfeiture of deposit and/or rental money, and the party will not be permitted to check in.
10. Written Exceptions
Any exceptions to the policies mentioned above must be approved in writing in advance.
*£99 deposit offer runs through until 31st December 2021 after which it will revert to a 20% deposit.
